Terms of Service

Welcome to Nibo. These Terms of Service (Terms) govern your use of the Nibo application, whether you are a registered or unregistered user (User or You). It is essential to read and understand these Terms before using our service. By accessing and using Nibo, you agree to be bound by the terms outlined here, any future amendments to these Terms, and the user guidelines established based on them. If you do not agree with these terms, you must discontinue your use of Nibo immediately.

1. Applicability

These Terms apply to all Users of Nibo, including current and future versions. Supplementary Terms, provided at the end of this document, may also apply to Users residing in specific countries.

2. User Consent

By accessing and using Nibo, You agree to be bound by these Terms.

All Users, whether registered or not, are subject to these Terms.

3. Amendment of Terms

We reserve the right to amend these Terms as necessary. Your continued use of Nibo after any amendments constitutes your acceptance of the updated Terms.

4. Termination

If You do not agree with these Terms, you must discontinue use of Nibo immediately.

Supplementary Terms

Additional terms may apply to Users residing in specific countries. These terms can be found at the end of the document.

Chapter 1. General Provisions

1. Purpose

These Terms establish the rights, obligations, and responsibilities of the Company and You regarding your use of Nibo on your personal computer or mobile device (collectively, Device). This use occurs by downloading the service application (Nibo App) from the Google Play Store or Apple App Store (Application Store(s)) or by accessing the service website (Nibo Web) provided by the Company. Please note that these Terms govern the legal relationship between You and the Company. Your relationship with the Application Stores is subject to their respective terms and conditions.

2. Changes to these Terms

The Company reserves the right to modify these Terms from time to time as deemed necessary, provided such modifications comply with relevant laws and regulations.

When the Company changes these Terms, it will notify Users of the reasons for and the effective date of the changes at least seven (7) days in advance. However, if the changes are unfavorable to Users, the notification period will be at least thirty (30) days. Your continued use of Nibo after the effective date of any changes constitutes your acceptance of those changes. If applicable law requires a refund due to a change, you will be entitled to such a refund. Changes that benefit Users or are made for legal reasons may take effect immediately.

3. Additional Terms

Matters not stipulated in these Terms shall be governed by relevant laws and regulations, the Company s Terms of Service for individual services, and the operational policies and rules set by the Company.

4. Notification and Communication to Users

The Company will contact Users regarding Nibo by posting notices on the Company s website or applications, using the information supplied by Users, or by any other method the Company reasonably deems appropriate.

You must update or notify the Company of any changes to the information you provided during registration. The Company is not liable for any disadvantages resulting from your failure to do so.

Chapter 2. Ownership and Licenses for Nibo

1. Ownership of Nibo Contents

Unless otherwise stated, Nibo contents refers to text, graphics, images, illustrations, designs, icons, photos, and other related phrases provided to Users within Nibo. Unless otherwise stipulated by law or contract, all exclusive ownership rights in Nibo, the Nibo App, the service website, the Privacy Policy, User Guidelines, related documentation, information, contents (collectively, the Company Assets), and the selection and arrangement of Nibo contents belong solely to the Company.

The Company Assets and the selection and arrangement of Nibo contents are protected by copyright and other relevant laws, including international intellectual property treaties. The Company Assets include confidential and proprietary trade secrets, and You agree to take necessary actions to protect their confidentiality.

Any new releases, modifications, or enhancements to the Company Assets belong solely to the Company and its licensors. No implied license, right, or interest is granted to You beyond what is expressly stated here, and the Company reserves all rights not expressly granted to You.

2. Scope of License for Nibo

The Company grants You a personal, limited, non-commercial, non-exclusive, non-sublicensable, non-assignable, and revocable license to download, install, and use one copy of the Nibo App in object code format on your Device, solely for personal use of Nibo. This license covers only the object code version of the Nibo App; you have no rights to the original source code. You may only use the Company Assets for the personal use of Nibo.

If You use the Company Assets beyond the scope of this license, the Company may revoke the license at any time. The Company will notify You of the reason for revocation without delay, unless prohibited by law or if notification could reasonably cause harm to Users, third parties, or the Company.

3. License Regarding Your Information

By downloading the Nibo App, You grant the Company a free license to access, collect, and use the address books, contact lists, and phone identifiers (IMEI, Unique Device ID, etc.) on your Device in accordance with relevant laws and the Company s Privacy Policy to enable the use of Nibo.

4. Content License

When You upload or provide Content (e.g., video, audio, photos, text, branding, software) on Nibo (note that Nibo Live Content is governed by Article 5(1), Chapter 6), You grant the Company and its affiliates a non-exclusive, unlimited, royalty-free, worldwide, sub-licensable, and transferable license for such Content. The Company and/or its affiliates may use, host, store, reproduce, modify, edit, adapt, or create derivative works from Your Content under this license. Accordingly, You agree that any Content you provide (except for Your Nibo Live Content) may be viewed by other registered Users. You can delete Content individually or by deleting your account. To prevent unauthorized use of Your Content outside of Nibo, You authorize the Company to act on your behalf against infringing uses by other Users or third parties. This license is for the limited purposes of operating, developing, providing, improving, and promoting Nibo, and researching new services, in compliance with applicable privacy laws.

5. Restrictions

You shall not

Use the Company Assets for any commercial purposes.

Copy, modify, adapt, translate, distribute, or create derivative works based on the Company Assets.

Sublicense, lease, lend, assign, sell, license, distribute, rent, export, re-export, or otherwise transfer rights in the Company Assets to any third party.

Decompile, disassemble, reverse engineer, or attempt to discover any source code, underlying ideas, UI techniques, or algorithms of the Company Assets.

Remove, obscure, or alter any copyright or other proprietary notices contained in the Company Assets.

Destroy, disable, or circumvent any copyright protection or digital rights management mechanisms related to the Company Assets.

Chapter 3. Commencement of Service Use

1. Consent to the Terms

Nibo offers services to both unregistered users (Basic Service) and registered users who have completed the sign-up process (Member Service). Specific details on service types and usage are provided in these Terms, within the Service, or in separate notices from the Company. By accessing and using Nibo, You agree to be bound by these Terms, their amendments, and related user guidelines. If you disagree, terminate your use immediately.

2. Membership Registration Process

You can register by following the Company s procedures. Membership is complete once the Company accepts your registration.

You can log in using various methods, including your phone number. If you use a phone number, you can link an email address. If an account is created with a phone number but not linked to an email, logging in on a different device or after reinstalling the app will result in the deletion of that account and all associated user information, as per Article 1, Chapter 8.

You must provide true and accurate information during registration and are responsible for any disadvantages or legal liability resulting from false information.

The Company will generally accept registrations without delay but may refuse or impose restrictions (e.g., account suspension, content deletion) if

Registration uses a false or another person s name.

False information is provided, or required information is omitted.

The User is under 17 years of age.

The registration violates relevant laws, regulations, or Company standards.

The Company will notify You of such measures and the reasons without delay, unless prohibited by law or if notification could cause harm.

3. Eligibility

Nibo may not be used in jurisdictions where such services are prohibited.

Nibo is intended solely for Users who are seventeen (17) years of age or older. Any use by anyone under 17 is a material violation of these Terms.

You affirm that you fully understand these Terms and are competent to comply with them. You may only use Nibo if you are capable of understanding and adhering to these Terms.

Chapter 4. Rights and Obligations of the Company and Users

1. Obligations

You must use Nibo in compliance with these Terms, their amendments, Community Guidelines, and any applicable user guidelines. If you do not agree, you must stop using Nibo immediately.

2. Prohibited Acts

You shall not engage in illegal or inappropriate activities regarding the Company Assets. Prohibited acts include, but are not limited to

Using the Assets for any illegal purpose or any purpose not explicitly authorized.

Damaging, disabling, or overburdening the Company Assets.

Transmitting worms, viruses, or any destructive code.

Violating laws, regulations, court orders, or binding administrative measures.

Undermining public order or moral customs.

Infringing upon the intellectual property, moral, proprietary, reputation, or privacy rights of the Company or third parties.

Transmitting or posting excessively violent or sexual content, discriminatory expressions, content promoting suicide, self-harm, drug abuse, or other anti-social content.

Impersonating the Company or a third party or disseminating false information.

Engaging in account hacking, identity theft, credit card fraud, or other inappropriate payment acts.

Spamming Users (e.g., sending unsolicited messages, indiscriminately adding friends).

Using Nibo for unauthorized sales, propaganda, advertising, solicitation, profit-making, obscene acts, soliciting prostitution, slandering, defaming, harassing, or insulting other Users.

Providing benefits to or supporting criminal or anti-social organizations.

Using Nibo for financial crimes.

Encouraging participation in religious activities or organizations.

Interfering with Nibo s servers or networks, manipulating the service using BOTs or cheat tools, exploiting system failures, making unreasonable inquiries, or hindering the Company s operations or other Users use.

Recording, screen capturing, or photographing within Nibo and leaking or distributing such data to a third party, except using specific recording features provided by Nibo in compliance with local laws and additional terms. You are fully liable for complying with laws and any restrictions requested by recorded Users. The Company is not liable for any use of such recordings.

Sharing your password, lending your account, or accessing Nibo with another person s account.

Using Nibo for purposes other than its intended use.

Aiding or encouraging any of the above acts.

Altering another website to falsely imply it is affiliated with the Company.

Using Company Assets to falsely imply affiliation for commercial purposes.

Accessing Nibo by any means other than the interface provided.

Exchanging the right to use Nibo for cash, property, or other economic benefits unless permitted by the Company.

Violating these Terms or Community Guidelines.

3. Prevention of Unauthorized Use

The Company reserves the right to take lawful measures to prevent unauthorized or illegal use of Nibo, including technological barriers, IP mapping, and contacting your wireless carrier.

4. Protection of Personal Information

5. Feedback

Any comments, suggestions, or feedback (Feedback) you submit to the Company regarding Nibo becomes the Company s property.
